These General Terms & Conditions apply to all Planet Africa Safaris travel services.
Planet Africa Safaris formalises its travel services through a so-called Travel arrangement (“Travel Arrangement”), which is an email with attachments that specifies amongst others your itinerary, accommodation details and price. The General Terms form an integral part of your Travel Arrangement.
Your Planet Africa Safaris Travel Arrangement constitutes a legal agreement between Planet Africa Safaris and you as our client. The Travel Arrangement shall only be deemed valid after we received:
i) A non-refundable deposit of 30% of the applicable fare.
The remaining balance is due 56 days (8 weeks) prior to departure date. In the event that the Safari Proposal is made within 56 days prior to departure date, the entire fare is due immediately.
Our prices quoted include all accommodation, transport, meals, transfers, park fees, entrance fees, flights within the country, community fees, guide services, flying medical service while on safari, and other services, planning, handling and operational charges as indicated in your Safari Proposal.
Our prices do not include: meals and transport other than specified in your Safari Proposal , personal expenses, bar bills and excess hotel charges, tips, airport taxes, international air fares and other overseas costs such as: visas, vaccinations and travel insurance.
Our prices also do not include expenses resulting from delays due to operational and other considerations or events, including but not limited to: bad roads or trails, water levels, weather, international or domestic flight cancellations, strikes, government action, sickness, war, quarantine, force majeure or political disputes.
Our quoted prices are based on current rates of exchange, tariffs and taxes. We reserve the right to increase our prices to cover increased costs, tariffs and taxes, and to reflect fluctuations in foreign exchange markets.
3. Cancellation policy
Our cancellation policy is as follows: after we have received your approval of your Safari Proposal, cancellations should be put in writing by the person whose name is on the invoice. Cancellations fee as follows:
• 30% non-refundable between confirmation and 56 days prior to departure;
• 100% non-refundable from 56 days prior to departure.
4. Itinerary changes
If you wish to make changes to your itinerary after we have received your approval of the Safari Proposal, we would need to receive those changes at least 56 days prior to departure date.
5. Itinerary changes by Planet Africa Safaris
The itinerary of your Safari Proposal is subject to change at the discretion of Planet Africa Safaris and, where applicable, of those in command of the vessel, based on operational and other considerations or events, including but not limited to: bad roads or trails, water levels, weather, international or domestic flight cancellations, strikes, government action, sickness, war, quarantine, force majeure or political disputes. You are not entitled to cancel your Travel Arrangement because of the itinerary changes, provided the changes are not in excess of 20% and the amended itinerary is not substantially different from the accepted Travel Arrangement.
6. Claims and refunds
For verifiable claims to be considered, they must be received by us – in our Cape Town office, South Africa – in writing within 30 days after completion of your trip and be accompanied by supporting documentation. Any adjustment considered will be based on the actual cost of the services involved and not on a per diem basis. Your Travel Arrangement is quoted as a package and credits are not given for any individual services or meals missed or not used. We will not accept any liability for any claims that are not received within 30 days of the termination of your trip.
7. Visa, health and insurance
It is your own responsibility to be in the possession of all necessary travel documents that may be required in respect of your itinerary, as well as all health and other certificates that may be required.
You will need specific immunizations when visiting East Africa, for which we recommend you seek medical advice. Our local representatives can provide you with contact details for such medical advice.
Although we strive to make your trip as enjoyable and safe as possible, it is your own responsibility to make sure you are fit enough to make the intended trip. It is extremely important that you make any medical problems known to us well before departure. Please contact us before you book should you have any specific health questions or concerns. Be aware that you are travelling in remote geographical areas which may have limited standards of hygiene, sanitation facilities, medical treatment and that medical services, including the presence of a physician or any other trained medical professional and availability of prescription type drugs may be limited or altogether absent.
We strongly recommend you obtain cancellation insurance and general travel insurance, including but not limited to coverage of repatriation costs in case of any emergency.
All baggage and personal effects are at all times at your risk, even when carried by porters. We will not be responsible for any loss, damage or accident to any luggage and property.
8. Flexibility, general conduct
Whilst we will do the utmost to make your travel as comfortable as possible and to closely adhere to the planned itinerary, you are expected to be flexible and open-minded as to any delays or last-minute changes to the itinerary. We cannot be held responsible for delays or alterations in the itinerary, or for expenses incurred, owing to operational circumstances or events, including but not limited to: bad roads or trails, water levels, weather, international or domestic flight cancellations, strikes, government action, sickness, war, quarantine, force majeure or political disputes.
In East Africa, specific rules and codes of conduct apply for visitors of parks, communities and campsites. Our guides and driver-guides are responsible for ensuring that our clients observe to these rules and codes of conduct. You should strictly follow their instructions at all times. If the applicable rules, codes of conduct or the instructions by our guide or driver-guide in respect thereof are not observed, Planet Africa Safaris reserves the right to terminate a tour or specific part thereof, or expel a person from a tour or specific part thereof. In these circumstances we shall not be liable to make any refund, and the matter will have no claim of any nature whatsoever against Planet Africa Safaris. You – at your own cost and at your responsibility – will be obliged to make your own way home.
We reserve the right without giving further notice, to make use of any photographs or film produced by ourselves during any of our trips for general publicity purposes without payment or permission.
10. Limitation of responsibility
You acknowledge that there are dangers and risks inherent in travelling to East Africa and agree to assume all the risks connected with or arising out of all aspects of your Travel Arrangement, and you waive any rights which you or your assigns or successors-in-title, dependants or heirs may have against Planet Africa Safaris or its staff, agents or associated companies in respect of your death, personal injury or other loss which you may sustain connected with or arising out of the Travel Arrangement, unless it can be proven that your death, personal injury or other loss is the direct result of gross negligence by Planet Africa Safaris or its staff, Planet Africa Safaris agents or associated companies. In any event, you acknowledge that the maximum indemnity by Planet Africa Safaris is limited to the minimum of either the actual costs incurred (consequential damage is not accepted!) or the total price of the Travel Arrangement, whichever is lower.
Planet Africa Safaris Ltd is registered in the British Virgin Island and its affiliated sales office is based in Cape Town, South Africa. Planet Africa Safaris purchases transportation, hotel accommodations, restaurant and other services from various independent suppliers that are not subject to its control. PLANET AFRICA SAFARIS CANNOT, THEREFORE, BE LIABLE FOR DEATH, PERSONAL INJURY OR ANY OTHER LOSS that may occur (1) due to any act or omission of any such supplier, (2) by reason of any other event over which it has no control.
Planet Africa Safaris does not accept responsibility for any arrangements made by the client outside of the pre-booked and paid for itinerary including but not limited to flights, properties, transfers and excursions. All such arrangements are undertaken at the client’s own risk.
Planet Africa Safaris does not disclose or sell its customer’s information to third parties. The company is committed to protecting your privacy.
12. Basis of agreement, applicable law
Your Travel Arrangement constitutes the entire terms of the relationship between Planet Africa Safaris and you as our client. No other terms and conditions exist regarding our relationship. The Travel Arrangement shall only be deemed valid after it has been agreed upon by you through payment of a deposit to Planet Africa Safaris. You acknowledge that save and except for what has been stated herein, there exist no warranties, representations, guarantees, promises, undertaking or inducements of any nature by Planet Africa Safaris whatsoever, and that no amendment, cancellation or waiver of any term or right referred to herein shall be valid or binding unless reduced to writing and signed by Planet Africa Safaris and yourself.
Where you are travelling with other persons, you shall be deemed to have warranted that you are authorised on behalf of such other persons to bind them to your Travel Arrangement. You accept personal liability for the entire Travel Arrangement, whereas the other persons accept personal liability for their part of the Travel Arrangement.
